Filing and Reporting Requirements
Inventory Filing Dates
Unlike the guardian of an incapacitated adult, who does not report to the Commissioner of Accounts, the conservator for an incapacitated adult shall report to the Commissioner of Accounts by the filing of an inventory and periodic accountings of all money and assets received and all expenses paid. The conservator shall file an inventory with the Commissioner of Accounts for Henrico County within four (4) months from the date of qualification.
Accompanying the inventory, the conservator shall submit a check payable to the Commissioner of Accounts for the Clerk of Court fees and the Commissioner’s fees. The Commissioner’s fees are set forth in the Order of the Henrico County Circuit Court establishing the fees of the Commissioner of Accounts. The Clerk’s fees are as follows depending on the number of pages submitted with the inventory including the pages on the inventory form:
1 – 10 pages……………………………$18.00
11 – 30 pages………………………….$32.00
31 or more pages…………………….$52.00
Accounting Filing Dates
The first accounting of a conservator for an incapacitated adult shall be filed, in triplicate, with the Henrico County Commissioner of Accounts six (6) months from the date of qualification for the first four (4) month period from the date of qualification. If the qualification occurred on January 1, 2010 the accounting shall be filed in triplicate on or before July 1, 2010 for the period ending April 30, 2010. Accompanying the first accounting shall be a check payable to the Commissioner of Accounts for the Commissioner’s fees and the fees of the Clerk of Court.
The second and subsequent accounts shall be filed, in triplicate, sixteen (16) months after the ending date of the preceding account for the twelve (12) month period following the ending date of the preceding account. If the qualification occurred on January 1, 2010, the first accounting would be due on or before July 1, 2010, for the period ending April 30, 2010. The second accounting would be due on or before September 1, 2011 for the period from May 1, 2010 through April 30, 2011.
Upon the death of the incapacitated a final account shall be filed within four (4) months of the date of death.
Each accounting shall be filed in triplicate and a check should be made payable to the Commissioner of Accounts based on value of the estate for his fees and the clerk of court filing fees.
Guardianship Reports
Please remember that guardianship reports for incapacitated adults are not filed with the Commissioner of Accounts, but are filed with the Henrico County Department of Social Services on Form CC-1644.
Conservatorship inventory and accounts are filed with the Henrico Commissioner of Accounts.
